  • [H3] Spring 2015 I was contacted by ‘naked house’ contractor PP. Based on the tender drawings and specification by the architect who had referred them to me, PP promised full services to deliver my design for the wholly completed Passivhaus under the ‘naked house’ scheme, by Christmas 2015, and for which they took 90% of the contract sum. 
  • [H3] Employing a prefabricated timber frame supplied by Eco House International (EHI) in Latvia, doors and windows are by GreenSteps, with whom PP is allied to deliver the ‘naked house’ scheme. As an example, they showed me around “GreenSteps timber frame eco-houses” in East Dulwich.
  • [H3] An initial period of construction gave rise to serious causes for concern, including damage to the neighbouring properties. It has been followed by four years during which, while publicly paying lip service to their responsibility for the defects and for putting them right, they repeatedly contrive to circumvent rectifying the defects or completing the work
  • [H3] My project “Elephant & Castle – A newbuild Passivhaus in central London” was removed from the ‘naked house’ Projects page for “commercial reasons”, all subsequent projects were put through their parallel company, while the building was left neglected and deteriorating as coverings failed and it became increasingly exposed to the elements. 
  • [H3] Having departed from the tender design PP refuses to supply documentation of the building ‘as built’ to me or as required by external assessors eg building control or the Passivhaus certifier. Meanwhile accounts given, particularly of the foundations and underground pipes, sought to deny serious causes for concern. They repeatedly refused to comply with the requirement, by building control and an Adjudication Decision, to substantiate their versions, which proved to be false. This is an offence.
  • [H3] Pressing for acceptance of their false account of the building, PP repeatedly refused to address all other issues or take matters up with their PI insurers. As a result, given that the policy had been renewed year on year without disclosing “grounds likely to give rise to a claim”, cover for all defects was refused. These defects are such as to cast doubt even on the cost effectiveness of repair. PP finally defaulted completely on their contract, passing the entire burden on to me, including likely prosecution by Southwark Council for failure of building standards.
  • [H3] The building they are content to deliver falls spectacularly short even of the promises made for the basic ‘naked house’ scheme for “successful Passivhaus construction”.
  • [H3] ● Foundations and underground pipes; there is cause for concern about the manhole now partially demolished and made inaccessible beneath the slab, the integrity of the foundations and underground pipes where they affect one another and the adequacy of the rebar. This requires the reinstatement of the manhole and extensive further exploratory excavation and repair.
  • [H3] ● Vulnerability to damp; inadequate DPM, non-waterproof plasterboard on outside of side walls in contact with neighbouring walls unprotected by a damp course and the positioning of the bottom of the timber frame 120mm below the level of the pavement, give serious cause for concern about continuing vulnerability to damp in the long term. A TRADA survey of the integrity of the structure is required.
  • [H3] ● Passivhaus/Mechanical Services; none of the pipe runs were, as had been promised under the scheme, incorporated into the prefabricated wall panels. Any pipes added subsequently, to no given plan, are destructive and substandard. No heating or ventilation equipment has been installed. All requests, by me or Passivhaus certifier Peter Warm, for drawings, specifications, calculations, PHPP, air tightness etc are stonewalled.
  • [H3] ● Cladding/render/flashing; the application of the Marley Eternit panels fails to meet any of the manufacturer’s requirements; all the membranes, battens and cladding, need to be replaced, the side walls remain to be rendered and horizontal and vertical flashing installed.
  • [H3] ● Generally throughout; the standard of building work is “incredibly poor” and incomplete: ‘office’ doors already bent and broken; lost keys and an inferior replacement front door lock; flaking and damaged paintwork on doors and windows; office consumer unit not in the office; stairs that deviate inexplicably from the design and the regulations; the wood supporting the roof terrace decking resting directly on the roof covering, frequently damp and hindering the already inefficient flow of water from the roof; hoppers blocked by loose timber in the parapet; water meter disconnected and discarded; sections of insulation and wall linings missing. Lighting, flooring, bannister, handrails, decorating, front step, capping to the parapet, sedum roof, solar panels, water tank, kitchen, bathroom etc either defective, not started at all or not finished. All this despite the promised completion date of Christmas 2015.
  • [H3] ● No specifications, instructions, guarantees or certificates etc, that would normally be required or were promised in the contract, have ever been supplied.
  • [H3] I was 65 when the defects in the building became apparent and I faced the shocking realisation that I now had neither my savings nor the building I was relying on as a home and to provide me with an income from the ground floor office. Now I am 70. Years of spurious excuses and dismissive treatment have culminated in the clear expression of just how exploitable and expendable they regard my project and me, a single female pensioner.
